These Terms and Conditions govern your access to aquahale.com and your purchase of products or subscriptions from Aqua Hale. By using the website, placing an order, creating an account, or enrolling in a subscription, you agree to these terms.
Website Use
You may use this website only for lawful personal or commercial purchasing purposes. You may not:
• Interfere with the website’s operation or security
• Attempt unauthorized access to accounts or systems
• Introduce malicious software
• Scrape, copy, or misuse website content
• Submit false, fraudulent, or misleading information
• Use the website in violation of applicable law
Product Information
We make reasonable efforts to present accurate product names, descriptions, compatibility information, prices, images, and availability. Product packaging, colors, labeling, and manufacturer specifications may change.
Customers are responsible for reviewing product details and confirming compatibility before purchase. The spa-product finder is provided as an informational tool based on the manufacturer, series, model, year, and other information supplied to Aqua Hale.
If you cannot identify your spa or are uncertain about compatibility, contact the Aqua Hale team before ordering.
Spa Compatibility
Series, model, year, and serial-number information may appear on a manufacturer sticker near the spa’s filter area. Customers are responsible for entering accurate spa information.
Aqua Hale is not responsible for an incorrect product selection resulting from inaccurate, incomplete, or incorrectly entered spa information. This does not limit any rights that cannot legally be waived.
Orders
An order confirmation acknowledges receipt of your order but does not guarantee acceptance. Aqua Hale may cancel or limit an order because of:
• Product unavailability
• Pricing or listing errors
• Payment failure
• Suspected fraud
• Shipping restrictions
• Incorrect customer or delivery information
• Other circumstances preventing fulfillment
If a paid order is cancelled by Aqua Hale, the applicable payment will be refunded.
Pricing and Taxes
Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, and other fees will be shown during checkout.
Aqua Hale may correct pricing errors and cancel an affected order. Prices may change without notice, but changes will not alter an order already accepted unless required by law or agreed to by the customer.
Payment
You authorize Aqua Hale and its payment providers to charge the payment method selected during checkout for the order total and, for subscriptions, future recurring charges disclosed before enrollment.
You represent that you are authorized to use the payment method provided.
Shipping and Delivery
Shipping availability, charges, and estimated delivery times are displayed during checkout or communicated with the order.
Delivery dates are estimates and are not guaranteed. Aqua Hale is not responsible for delays caused by carriers, weather, natural disasters, incorrect addresses, government actions, or circumstances outside its reasonable control.
Customers are responsible for providing a complete and accurate shipping address.
Subscriptions and Automatic Renewal
Certain products are offered through automatically renewing subscriptions.
Before enrollment, the applicable product page or checkout will disclose:
• The recurring price
• Billing frequency
• Shipment schedule
• Products or benefits included
• Any initial charges
• How the subscription may be cancelled
By enrolling, you authorize recurring charges to the payment method on file until the subscription is cancelled.
Aqua Hale’s subscription bundles may bill monthly while providing products on different shipment schedules. The billing and shipment schedule shown for the selected plan controls.

Subscription Cancellation
You may cancel a subscription through the cancellation option available in your customer account or by contacting:
Cancellation stops future renewal charges. Unless otherwise required by law, cancellation does not automatically refund a charge already processed or an order already prepared or shipped.
Customers should cancel before the next scheduled renewal date to avoid the next charge.
Subscription Changes
Aqua Hale may change subscription pricing, included products, shipment schedules, or other material terms when reasonably necessary. We will provide advance notice of material changes and instructions for cancelling before the change takes effect when required by law.
Returns and Refunds
Returns, replacements, and refunds are subject to Aqua Hale’s posted Refund and Returns Policy.
Products must meet the conditions stated in that policy. Certain opened, used, installed, contaminated, clearance, customized, or chemical products may be ineligible for return where permitted by law.
Nothing in these terms limits rights or remedies that cannot be waived under applicable consumer-protection law.
Damaged, Incorrect, or Missing Products
Contact Aqua Hale promptly after delivery if an order arrives damaged, incorrect, or incomplete. Include the order number, description of the issue, and photographs when applicable.
Do not discard damaged packaging or products until the matter has been reviewed.
Product Use and Safety
Customers must follow all product labels, manufacturer directions, dosage instructions, installation requirements, warnings, and safety precautions.
Pool and spa chemicals must be stored, handled, and used exactly as directed. Never combine chemicals unless expressly directed by the manufacturer. Keep chemicals and maintenance products away from children and pets.
Aqua Hale is not responsible for injury, property damage, equipment damage, or water-quality problems caused by misuse, incorrect dosage, improper storage, unauthorized combinations, or failure to follow instructions.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Notify Aqua Hale promptly if you believe your account has been accessed without authorization.
We may suspend or terminate accounts involved in fraud, abuse, unlawful activity, or violations of these terms.
Intellectual Property
The website’s text, graphics, branding, page designs, photographs, icons, and other original content are owned by or licensed to Aqua Hale and are protected by applicable intellectual-property laws.
Manufacturer names, product names, logos, and trademarks belong to their respective owners.
Third-Party Services
The website may rely on third-party services for payments, shipping, analytics, subscriptions, chat, and other functions. Aqua Hale is not responsible for interruptions or acts of third-party providers outside its reasonable control.
Disclaimer of Warranties
To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. Aqua Hale does not guarantee uninterrupted access, error-free operation, or that every product will be suitable for every customer’s equipment or intended use.
Products may also be covered by warranties provided by their manufacturers. Any manufacturer warranty is governed by the manufacturer’s terms.
Limitation of Liability
To the fullest extent permitted by law, Aqua Hale will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, product incompatibility, misuse of products, delivery delays, or interruption of services.
Aqua Hale’s total liability concerning a product or order will not exceed the amount paid for the product or order giving rise to the claim, except where a different remedy is required by law.
Indemnification
You agree to indemnify and hold Aqua Hale harmless from claims, losses, or expenses resulting from your unlawful use of the website, misuse of a product, violation of these terms, or infringement of another person’s rights.
Governing Law
These Terms and Conditions are governed by the laws of the State of Hawaiʻi, without regard to conflict-of-law principles.
Any dispute will be brought in a court of competent jurisdiction located in Hawaiʻi, except where applicable law gives the customer the right to bring a claim elsewhere.
Severability
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect.
Changes to These Terms
Aqua Hale may update these Terms and Conditions. Changes will be posted with a revised effective date. The terms in effect when an order is placed will govern that order, except for legally required changes.
